Can you please tell me what is deed of Assignment. As far as i know Deed of Assignment is only for transfer of Trade mark by the selling company to purchasing TM company, am i right or it refers to something else

LL Agreement

I am a south indian recently relocated to mumbai.

I am staying in MIRA road in mumbai. Recently I have seen a new flat for rental purposed in the same area. I have paid Rs 15000 as rental advance/deposit and the leave and license agreement was prepared(two copies - one original registered and duly attested by notary and another one copy for tenant).
The advance was paid on 9th December 2009.

The owner said he will come next day for the NOC(in mumbai NOC from the area police station is compulsory for rentals. Tenant has to submit his ID,Adress proof, educational and employment documents.After verifying police will grant NOC. For this both tenant and owner should go to the police station).

But the owner did not turn up for the next 10 days nor he informed over phone. So with doubt , I approached the housing society and came to know his mother expired and he went to his native.

On 21st Dec he called the broker and informed that his mother expired and he will refund the advance on 22nd. But again he didnt turn so far.

His residential address filled in the agreement is incomplete. We could not locate his address. His phone no is temporarily dis connected.

Please guide in the above case to recover my deposit.

Note :

I could not occupy the house without NOC from police station . So I have shifted to another house.

I have the registered copy of the agreement as well the second copy.

In the registered copy he has signed in a revenue stamp for the receipt of advance and he has given his right thump impression on his photo.

Are these evidences enough?

equitable mortgage on agricultural property

Further to my query, can equitable mortgage be created by a financial institution on agricultural land for a loan (as per RBI guidelines the same is treated as Indirect Agri finance)granted by the bank to a corporate firm in Mahdya Pradesh. That is to say, can EM on agri land be created in MP for a agri loan granted to a corporate?

rent-tenant

Sir
my uncle purchased an Apartment from Mr A and Sale deed registered in favor of him on 15-04-08 but from that day omwards on mutual consent Mr A is not vacated the Apartment and paying monthly rent to my uncle and they didnot written any lease agreemet. So please suggest me what precautions we shall take so that we will not face any legal complications in future(As the previos owner did not handed over possession of the property)

HOW TO COUNTER THIS. ALSO,WHILE DRAFTING NDA/CA THEY GENERALLY KEEP DAMAGES OR EQUITABLE RELIEF INCLUDING MONETARY RELIEF. HOW SHOULD WE COUNTER THIS.

As per the present laws, can equitable mortgage be created by a bank on an agricultural land for a agricultural loan sanctioned by it to a corporate firm

validity of copydeed of a partition deed

I am putup at coimbatore,Tamilnadu.Myself ,my one brother and four sisters (6 family members)are going to share our ancestrol propertis,viz.agri lands,as our father and mother are no more,by registering partition deed.we decided to keep the original of the partition deed with the eldest and others to have the copies.Somebody says that the copy document has no value when we go for mortgage for loan etc..Is it correct?If so,then what is the alternate?
Registerig counterpart for eachone will involve more expenses.
Please suggest a suitable solution sothat the copy documents are also have the same validity as that of the original.

indeminty bons

Hi
We have filed application to AO. for claiming non deduction of TDS certificates on behalf assessee (NRI).
The Assessee has selling his immovable property. Assessee (NRI) is in process to invest in New residetial house u/s 54F of I.Tax.For thet AO has asked for Indeminty Bond regarding guarntee for payment of due tax if assessee (NRi) has not invest in cpital gain scheme or Residential flat u/s 54F.
I needs draft form of indeminty bond.Pls.provide me format of the same.
