Hi,

I have to get my mom's Passport made but unfortunately she has lost her high school certificate(passing year 1970) and does not have any birth certificate. However I have her voter's i card and Pan Card.

I tried calling the helpline of Passport seva kendra but they say its only birth certificate or 10th certificate they will accept under Date of Birth Proof as she is M.A.

Now since she was born in 1956 so no birth certificate and Getting a duplicate from MP state Board is next to impossible for me since I am based out of Punjab.

I am stuck. Please Help.

Certified copies

Asansol Civil Court does not have a proper Xerox Machine and is always running short of xerox papers. As a result of which Certified copies of cases and judgemnts are not available even on special request petitions for months together.

Due to this, citizens ,both plaintiffs and defendents are unable to appeal in higher forum and the high court.

The Law Minister Of West Bengal, who is also an MLA from Asansol itself has also failed to resolve the issue.

The lawyers used to "MANAGE" some copies at exhorbitant fees, but there was some tiff amongst the lawyers and this has also stopped.

Lawyers explian the the court has ordered only 40 sheets per day to be xeroxed and the turn may come after years.

As a ordinary citizen, I fail to undestand who should be approacehed to resolve the problem.

Even the bar association is silent and docile about the matter.

It is also a known fact that lower courts are very conservative on Judgements and even simple injunctions are rejected on filmsy ground.

As things stand, Only Persons interested in geeting matters lingered go to the court.

What is the meaning of Justice delayed is justice denied?

Please help.

The citizens Forum is even willing to sponsor a new Xerox Machine.

Sec 138

my client has given certain undated cheques for the bills outstanding.

on his letter head there is a condition "kindly note all above cheques are only for the purpose to show your bankers as a security deposit and confirmation of outstanding balance with us.pls do not deposit the cheques unless an until you get our written confirmation, kindly acknowledge."

i have only put my initials on the above and it does not even bear my company rubber stamp.

1) what can i do to recover my outstanding amounts?
2) how can i use these cheques?
3) what if he does a stop payment of the cheques?
4) do i have to wait till he gives me a written confirmation to deposit the cheques as i have just put my initials and what is its legality?

i even have the delivery challans bearing his signature and some have his company stamps also.

He also has mentioned cheque nos, bank name, and amount on my outstanding ledger on which he has written "above mentioned cheques has been given for this statement(outstanding)".

pls suggest a way in which i can get my hard earned money back bcoz i think he dosent intend to repay.

Joint property - partly sold - remaining partition?

4 persons have jointly purchased a property having rights of different shares. 3 of them have sold their undivided share to 5th person and executed a sale deed in 5th person's name which has been registered in the concerned registration office. the problem is,
i. can the 4th and 5th persons partition the property as they are the present owners of undivided share of the entire property?

can the 4th person release his/her share to the 5th person?

or, is there any other possibility?

Conveyance deed.

We are registered Housing Society situated at Dombivali (East) from 1994. The Housing Society is registered in the year 1999, however, till date the Conveyance of Land & Building of the Society has not been executed by builder.

Society has filled Legal case against Builder in the Kalyan Court in the year 2002.

From last one year we are trying to compromise with builder for the conveyance of Society. Builder is now ready to execute the conveyance, accordingly we have organize all the required documents along with final Conveyance Deed (on Stamp Paper of Rs.5,000/-) which has accepted by Builder.

However, now builder is asking us to withdraw Legal Case filed against him before registration of Conveyance Deed.

Please let us have your suggestion for the same.

Joint venture agreement

Sir, we are a construction co. engaged in road construction work.

1) We wish to form a Joint Venture Firm with another firm, but the registrar of firms says that the two firms cannot form a Joint Venture Firm. We had applied for a Joint Venture Firm with the name of PMA Construction Co. (JV), but the ROF says that PMA Const. Co. is already registered and therefore the JV Firm cannot be registered with the same name as the both firms are engaged in the same nature of business. Our argument is that we are forming a JV firm and added the '(JV)' word to the name of new firm. But they are not convinced. We have made the agreement with the name of "PMA Construction Co. (JV)" and issued a tender form to participate.

2) secondly, can we give a title to the JV firm as "Agreement of Joint Venture" instead of "Deed of Partnership" as the new firm is joint venture for a specific work and not a regular firm.

3) The ROF says that the Joint Venture cannot be registered with office of the ROF. The ROF also added that the two firms cannot form a new firm with any name. The new firm should be formed by the partners only and not by the firms. Is it true ?

Kindly guide us on this. Thanks.
