Registration of construction agreement in tamilnadu for flats

1. In a Joint Development Agreement, the Land Owner(A) is paid money for registering the UDS and do not have any rights to any of the flats constructed by Builder(B).
2. The Builder is spending the construction amount and has FULL rights to himself for all the flats therein as per the terms of the JDA.
3. The Project is in state of TamilNadu where, registration of the construction agreement is compulsory with Sub registrar.
4. The Sale Deed with UDS is registered by "A" the land owner for all flats except 4 flats.
5. The construction agreement is registered by "B" as the Builder favouring all the Purchasers, except for 4 flats remaining unsold.
6.In the end, 4 flats remain unsold in the above manner and the BUILDER-(B) receives construction cost from Land owner (A) and hands over possession of the 4 flats to A. BUT the construction agreement is not Registered with SUb registrar, which is mandatory in TN.

7. Query:
(i) Does (A) the land owner gets legal title for the 4 flats,when the Construction agreement is not Registered?
(ii) when the JDA specifically mention that ALL THE FLATS BELONG TO THE BUILDER, can he pass the legal title without registration by mere handing over of the possession.
(iii) CAN the Landowner get full legal title to the FLAT, without having a valid registered Construction agreement in his favour.
(iv) MOST IMPORTANT. THE LAND OWNER IS A REGISTERED COMPANY-(A) AND THE BUILDER IS ALSO A REGISTERED COMPANY (B) having separate legal entity and identity. But They have common Managing Director. So, is passing the unsold flats to company A correct in Law?

Sale deed - builder/society rights on commercial facilities in club house

Dear All,

Please advise,

I purchased flat in gated community in Hyderabad.

In the registered sale deed of all flats owners of gated community builder mentioned following point regarding club house- The Vendor/Developer have all rights to sell the whatever, commercial facilities provided in club house to any other person, without consent of flat owners.

All flat owners have registered society recently, awaiting for builder to handover corpus fund and other rights to the society.

My question is that -

who will have rights over saling commercial facilities provided in club house builder or society?

Does builder have right to sale/rent the space provided in club house to supermarket/restaurant or not?

Validity of signed 20 rupees bond

One of my friend signed a blank 20 ruppee bond with his business partner and left the business. Now he is starting a new business . He is just worried that if his old partner might cause some leagal issue with that signed bond. So I would like to know how long is the bond valid.

Valdity of decree with register deed

The co-opertive bank in maharshtra has got a decree against surety under 101 mcs act but after carful examination of documents it found that , the bank sanction three loan first in 8-8-2010 for 48 lac where they execute all the necessary documents inculding promissory note , agreement , consent letter and the bank has excuted register mortgage deed of surety ,
2)same borrower again applied 55 lac loan for in 16-12-2012 where the first loan outstanding is 31 lac where the bank has used same surety but this time they have used the signature of surety which they sign on blank paper for first loan then they excuted promissory note and consent letter without mortgage deed
3) again borrower has applied for 3rd loan in 7-5-2013 for 118 lac again bank has sanction loan with alleged signature of surety without any register mortgage deed

* Bank has created charge over properly for all three loan
* borrower crediter and surety for all three loan are one
* Surety are ready to settle first loan
*) Bank has got decree over surety

Any advice in related to defence in concern matter are helpful.

Blank signed a4 sheets

Dear Sir,
During my visit to my hometown in UP, I hv to sign blank A4 sheets of paper & give it to a local advocate for filing an affidavit & application to court for enrollment of my name in the property as my father has passed away. (In UP I have ancesteral property house jointly in the name of my father & his brothers).
Can these blank signed A4 white papersbe used against me.??
I asked the lawyer to return those papers, he has told me that they are destroyed.

Change of name and signature in passport

I recently got married and now i want to Change Name and Signature for my wife in Passport (She already has 1 old passport).
I have a Marriage Certificate .Please let me know if we need to Prepare any Affidavit for Change in Name and Signature for Making any Changes in Existing Passport?

If yes ,then can you please share a sample Affidavit or a Photocopy.
