Breach of agreement

Dear sir/madam,

My mother has entered an agreement for sale of our land on 3/05/2011 in Rs.20 stamp paper for a period of 100 days.
We have also given an extra time period of 50 days. still the purchaser is unable to Settle the balance amount.
The purchaser has given us 1/6th of total value of purchase amount as advance and also mentioned as within 100 days the purchaser is unable to settle the balance amount then he will lose a part of amount in advance amount given by him and also the agreement will be cancelled after the 100 days period.
Still the purchaser is not able to settle the balance amount and asking for an extra time period.
so kindly provide us the details to make the agreement legally cancelled.

prepare deed of cancellation through a local lawyer . forfeit the advance amount as per agreement

Cancel the agreement by serving a notice on the purchaser & return the balance amount, if any,after deducting your dues as per agreement.

You need to serve notice if no written communication made between two post the agreement,informing him that as time was essence of contract to be adhered by both of us for which you have been always ready and willing to execute but as he did not turn up the agreement stands revoked once for ever and the amount stands forfeited as agreed in the agreement.TAKE THE HELP OF A LAWYER.

yes i do agree with all experts. you can forfeit the amount and cancel the agreement by an advocate

As per agreement you are entitled to forfiet the amt. after serving notice as advised experts.

Thanks for all advices
i have consulted a lawyer and he was telling that if an agreement is signed it can be valid for 3 years, so u go for an compromise and return the full advance amount and get the agreement cancelled from the purchaser.

please clarify my doubt regarding the validity of the agreement. can it be valid for 3 years.
