Associate Member rights in Apartment RES KARNATAKA

An Associate Member who has become member in the Management committe of an Apartment RWA has misappropriated rs 1.5 lakhs. Can we recover money from him thru court and police as he has got no voting rights and he is not the real owner of the flat.
