ARBITRATION APPEAL CAN BE FILED IN DISTRICT COURT OR IN BOMBAY HIGH COURT DIRECTLY? IF AWARD IS 15 LAKH HOW TO FILE THE ARBITRATION APPEAL U/S 34?
This discussion clarifies that while direct appeals against an arbitral award are not permitted, objections can be filed under Section 34 of the Arbitration and Conciliation Act. These objections should be lodged with the District Judge or a Commercial Court, depending on the jurisdiction, rather than directly with the Bombay High Court.
