Querist : Anonymous (Querist) 20 October 2011 This query is : Resolved
hello sir,

we have filed an application u/s 411 CRPC in the court of SDM (sub divisional magistrate) for transfer of calendra U/s 145 Crpc to some other magistrate as SDM is not fair and biased and is party against us in high court in a connected case, but he (SDM) dismissed the same, we filed a revision against his order in sessions court, now Addl. Distt. Judge judge is saying that order of dismissal of application U/s 411 crpc is an interlocutory order and is saying to show citation/judgment/ ruling that the revision u/s 397 lies against the order of dismissal of application U/s 411 Cr.Pc, please help me please give me any ciatition/ ruleings etc.

Raj Kumar Makkad (Expert) 21 October 2011
As your application seeking transfer was dismissed so this is an interim application to the main relief sought under your petition under section 145 Cr. PC and revision is the only remedy but it lies with collector and not with Sessions Judge.
