Anticipatory bail after 5 years

(Querist) 29 March 2013 This query is : Resolved
It is a case u/s 406, 420, 468
Anticipatory Bail filed before Session Judge in Feb/2008 rejected.
Main accused and all co-accused got regular bail from high court.
AB again prayed before Session Judge in Feb/2013 and it was rejected.
Filing before High Court.
NOW THE QUESTION IS......"DELAY" to file AB!
Is there is any citation available in which AB allowed after such a long delay?
PLEASE SUGGEST...............

After change in circumstances fresh anticipatory bail application can be filed.
Adv k . mahesh (Expert) 29 March 2013
fresh AB can be filed stating the old case numbers also
Raja (Querist) 29 March 2013
High Court of Jharkhand and Bihar has rejected so many application with delay.

"change in circumstances" did nothing with those.

my matter is with jharkhand HC. so any specific judgement, which allowed AB after 5/6 years delay?
Devajyoti Barman (Expert) 29 March 2013
There is no time limit to file AB.
If charge sheet is filed , it is better to surrender and pray for bail in which context most of time bail is granted.

you are an accused since 2007, 438 rejected at Session Court in 2008, remained absconding, and now filing AB before HC. will the HC ask about the explanation for this delay! charge sheet not filed. it is showing absconding. total 5 accused are there, 2 arrested, 2 surrendered and got bail from HC, only this one is remaining.

any suggestion ?

Even the said offences are non bailable but triable by JMFC. Accused will get the bail
