(Querist) 23 December 2014 This query is : Resolved
sir,
i want to know the amount of court fees applicable to issue a succession certifiacte for my mother for the amount 86lacs(pF, gratuity and savings)for releasing of my father assets which he left without a will.
The lawyer i have consulted is demanding approx. 7.5 lacs(8.75%, as per indian court fees act for utter pradesh). Is it so? Also, why do anyone have to pay such a huge fees on a amount which is already tax paid.Is there any procedure to challenge this.?

court fees differs from state to state. Better consult another lawyer from UP.

Prbhakar Singh is from UP and he may help you on this.

The quoted court fee by the said lawyer seems to be out of proportion/exorbitant. The fact may be different, better change the lawyer and clarify the issue from some genuine people working in the court and are in the knowledge of it.

You must make sure whether you really need succession certificate. Balances of saving bank accounts etc from Banks can be claimed without production of succession certificate. Please give full particulars of the balances lying with i.e. bank or office.
