Alimony amount

Brief facts of my marriage
1. Got married on 24 nov 2012. Wife left my house on 27 dec 2012.

2. I and my wife never consummated the marriage. I and she have accepted this fact in front of judge.

3. Both need divorce.

4. She is MBA and earning more then me before marriage.

5. She is asking for 10 lakhs as compensation but I can give her not more then 2 lakhs.

6. No 498 case against me. She has taken her stri dhan. Her complaint in CAW cell is closed.

7. My father is retired govt employee and my mother is govt. employee. My salary is 13k per month. We have our own flat, my elder sister is married and i am only son of my parents.

Plz let me know can court fix any amount for compensation. I mean I am unable to pay more than 2 lakhs. My case is in tis hazari.

as both of you divorce,you should move to mediation centre of high court for mutual divorce, there you can reach a proper amount of compensation on mutual conscent.

If both parties are agreeable for mutual divorce, the issues of compensation should also be settled amicably. You remain insisting upon your own stand not offering more than rs. 2 lakh.

In mutual divorce the alimony if any decided by mutual consent.
If you can convince your wife you even need not pay anything.
So negotiate with her and file for MCD.

Both of you need divorce, mutual consent divorce with amicable settlement is better way. It would save time, money and tension.

For settlement of alimony have services of common friends, relatives and if not possible of mediation center.

Whether to pay compensation of Rs. 2 lakhs or more or not to pay compensation at all depends on the following:

1. Who is accountable for failure of marriage.

2. Who requires divorce decree urgently.

3. How much money she spent in / for marriage.

4. your paying capacity.

Sweet and reasonable negotiations from your side may possibly reduce the compensation amount or no payment at all.

Negotiations from both the sides before a mediator will work out for an amicable solution.

As it is going to be mutual consent, even the alimony should be decided amongst yourself.

Try court assisted mediation.
