Dishonour of Cheque – Territorial Jurisdiction. In the Said judgment what s.c. defined that i want to know simply. example, If the Cheque is drawn at S.B.I. whic is the bank of the holder of the cheque if that bank returned the cheque than a Bank where situated that court will have the juridiction. Please sir Explain i think this is one of the vital issue.

The territorial jurisdiction is restricted to the Court within whose local jurisdiction the offence was committed, which is where the cheque is dishonoured by the bank on which it is drawn.
complaint can only be filed in the jurisdiction of court where the accused bank situates.

read the recent judgement passed by SC few days back on this issue.
Now case can only be filed in the jurisdiction of drawee's bank where the cheque is dishonoured.

WHAT ABT PENDING CASES???EFFECT PROSPECTIVE OR Retrospective??

As abt 50% cases were filed where bank a/c of complainant ..
