I file a property case under civil suit. I want to know who send the summons as other party not receiving it. It is the lawyer or the civil court judge.

While lawyers file the initial requisition, the court is responsible for ensuring the summons are served on the opposing party. Sometimes, for efficiency, a lawyer's office may assist the court in delivering the summons. If the other party is evading service, the court can still proceed with the case and deliver a judgment.

Summons/notices are issued and get served to opposite by court but for convenience and early delivery of summons to opposite party, lawyers office assist court for delivery of summons to opposite party.

It is the duty of concerned Court which is helped by counsel of plaintiff to get it served upon defendant(s).

Hello,

The court issues summons/notices to the opposite party. There are other options to serve the notices to the opposite party. Ask your advocate to take the necessary steps to serve notices. If the opposite party is not accepting still court can pass the order and deliver judgment in due course of time.

Summons are issued by court, only requisition is filed by lawyer.
