What is the difference between medical insanity and legal insanity?

Querist : Anonymous (Querist) 05 September 2011 This query is : Resolved
Dear Experts,

What is the difference between medical insanity and legal insanity?
Raj Kumar Makkad (Expert) 05 September 2011
medical insanity doesn't mean the person is crazy. They are probably on meds and in the care of a psychiatrist and therapist but can do for themselves and lead a somewhat normal life. Of course there are illnesses like Alzheimer's and senile dementia that can be construed as medically insane and it's a physical problem that caused it. Legal insanity is when the person has to be supervised and has no control over finances or any decisions as ordered by a court judge. Someone takes responsibility for this person, as they cannot function on their own. Many think that insanity is just a mental thing but it is physical too and it has been proven by scientists and physicians. The neurotransmitters in the brain "misfire" when sending signals to respond in a certain "normal" manner from one side of the brain to the other. Legally insane people cannot sign anything. It usually takes 3 psychiatrists to declare the person legally insane and it is ordered by the judge in a court of law that they cannot function in society. Often times they are put in a psychiatric ward with the worse cases and are considered committed versus going to a psych ward on their own.

yes ! Mr. Makkad is right. legal insanity creates incapacity and one looses his/her recognition of a juristic personality.
