Respected Sir,

I have to file writ petition in respect of RTI for compliance of order of SIC.

1. Is it compulsory to make state government as party along with SIC ?

2. Whether notice under section 80 cpc required to be given to SIC ?

You may make the State Government and all the authorities under the RTI Act necessary parties.

In a Writ Petition, it is not necessary that Section 80 Notice be given.

You can lodge complaint with the SIC u/s 18 of the RTI Act.

Thank you to all for your replies.

SIC had ordered to register F.I.R. Complaint u/s 18 had been lodged & Sic ordered for disciplinary action & did not impose fine of 25000/- but they have not register F.I.R yet.

Opposite party is a statutory Housing authority.

1. Can I file writ without State government as information officer is a employee of authority.

My prayer to the court is to compliance of order of F.I.R. & penalty.

2. whether both the prayers covered under art. 226 or art. 227 applicable ?

You can file the writ as proposed by you invoking article 226 of constitution.
