Witness denied

(Querist) 25 August 2017 This query is : Open
I am plaintiff in the case and filed my affidavit in chief and also submitted application to court to call defendant no.3 as witness to prove certain documents and his handwriting for which opposite party counsel objected to this and court did not allow my application and dismiss the same. Experts please guide me what remedy available whether to approach High Court .

Do you want to call the said defendant as your witness?

Whether all your witness have deposed?

Why made defendant, if you wanted to make him your own witness?
kaur (Querist) 26 August 2017
In list of witness I have given name of defendant No.3 who is party in the case and as per evidence act plaintiff cannot be denied from calling the defendant as witness but same has been dismiss by lower court. Now request for your kind expert opinion as the witness is very much important and essential to prove documents before the court what remedy available.
Dr J C Vashista (Expert) 27 August 2017
Two contradictory stands i.e., initially the defendant (opposite party) now your witness, can not proceed.
You may confront the document at the cross examination of the defendant.
Consult a local senior lawyer for guidance with true facts and documents.
