The husband of one lady is heavy drinker and he already sold a property.
now he is in plan to sale the house in which he lived with his wife and 2 daughters.. the wife objected the same

the property is self acuiqred property by the husband...

whether the wife can stop her husband to sale that property...

pls reply urgent

Right to life, Right to Education are basic rights available under Constitution. Wife and Children may seek injunction from Civil Court, since the husband is a drunkard and he is not selling the property for the developmental purposes or betterment of children's education, etc., After selling, he will waste the money by betraying the family. So I hope the family has a good convincing case. Alternatively, you may also seek Court orders for a percentage of the amount to be deposited in the FD in a bank in the wife and children's names. You may consult your local lawyer and do it immediately. Also show the Court about what husband did with the money got from earlier sale of other property, which will stand as a proof of his conduct.

Under Domestic Violence Act, the wife & Children can seek orders from the court to stop the sale of the house.

Since the property is self-acquired, seeking remedy through Domestic Violence Act as suggested by Mr. Vishal is the right suggestion.

A decision was rendered by A.P. High Court which states that the moment the husband ties TALI to the wife, the wife wil have a charge on all the properties of the husband. In that view of the matter even if the husband sells the property it is subject to the charge of the rights of the wife and hence the wife can definetely approach a court of law to protect her rights,
