Hi All Experts !
i hav a query as my husband is divorcee . we both are muslims and my husband gave divorce to previous wife in 2009 April by written notice of Talaqnama through Register AD But it was refused by them 10 days they filed case of FALSE 498 plus domestic violance on him & other Family members. They have got bail aswell @ that time.
we got married in 2011. now we want to settel abroad & we are planning to move there in near future . These cases are pending & at time of Dates given by Courts hardly these People be present . its Pending in short . Also there is a child wit previous wife, which she never even showed to my husband & inlaws.
weather my husband will get permission to Travel abroad with Me or Not ?
If YES , What is the procedure to do Clearance for Abroad Travelling ?
for Maintainance case of Child what can be done if my husband is not in india ?
we need your expert advise please Guide

1. Your husband shall have to get permission from the concerned court and generally such permission is granted.
2. Take help of lawyer of your husband who shall draft it and shall move it before the court.
3. Recovery can be made from the properties of your husband in India and even such warrant of recovery can be got complied in a country wherein your husband is residing.

your lawyer will do the needful you must have negaged lawyer to fight 498 A case . ask him to make application to court .howver you will be issued passport and permission to travle abroad subject to terms and conditions . generally passport is issued for one year .

Normally the permission is granted, sometimes the court insists on higher security/ bail amount.
