You can file appeal along with an application u/s 5 of limitation act and your appeal will be admitted if you convince the court the reasons for delay.

what were you doing for 11 months . order is passed in february 2013 and we are now in january 2014 . you will have to explain the delay in your condonation of delay application
Devajyoti Barman (Expert) 12 January 2014
Appeal is to be preferred within 30 days of the order passed.
Here it is 11 months delay.
I do not think you can come up with any probable explanation to condone the delay.
Better file a petition in the lower court u/s 25 of the DV act and then challenge the order when it is passed.

I am sorry to say that although you are a Civil Engineer you are eager to know the Civil COURT RULES for filing an appeal.Whereas LAWYERS HAVE NO CURIOSITY TO KNOW THE PERCENTAGE OF SAND AND CEMENT REQUIRED FOR THE CONSTRUCTION OF A BUILDING. THEY ALWAYS RELY UPON THEIR OWN CIVIL ENGINEER SO WHAT'S THE HARM TO LEAVE YOUR QUESTION TO YOUR LAWYER?
T. Kalaiselvan, Advocate (Expert) 14 January 2014
Mr. Biswanath Roy has made some point. The appeal can be filed within 30days from the date of getting the judgment copy, however now you can file it with a delay condonation petition explaining the day today reasons for the delay
V R SHROFF (Expert) 14 January 2014
Mr. Biswanath Roy has made imp point.
