Transfer of R.C.Book, but not insurance from father and son

Dear Sirs/Madams,

This has reference to a Transfer of R.C.Book from Father to Son, but not in the Insurance policy, which stands in the name of the Father at the time of accident. Kindly advise me regarding the same and if any citation of the supreme court of india is in favour of the same.

so long as the vehicle is insured and the policy is in force,usually it makes no difference,whether the policy is transferred to the new owner,with regards to the accident claim.

however for claiming the damage of the vehicle,unless the regd owner and insured is same,no claims in this regard is payable.

I am not aware about any court orders contrary to what I stated above.

I differ with the views of Mr. Mahendra Kumar. Since the registered owner of the vehicle has changed on transfer of the RC, the old policy would become inoperative for the vehicle. Insurance cover would have been valid only for the past owner and his vehicle, not the present owner and vehicel, as the ownership has duly been transferred to the son by transfer of the RC. A new policy was required to be taken by the some on transfer of RC.

All the liability would rest with the presently registered owner having an uninsured vehicle.

no. the insurance will cover the particular persons only.. if we need mean we have to select such a special policies.. which is available for rider, or include the billion rider, or include the third party.. like this..
