Thika tenancy shop owner

i am a thika tenancy shop owner and give shop on rent and want to sell shop to the tenant for money on market value but tenant is willing to buy more than 50 percent less than market value..we need money for financial need, Am i able to sell the shop to other person and vacant the tenant by any manner

Yes you can but before that you need to first to evict that tenant which is very difficult.

There is legally no preferential right of the tenant to purchase the shop first from you rather it depends upon you to sell to him or not. If any party becomes ready to purchase the shop who shall get the eviction at its own then it shall be very useful for you.

I request the Ld.Experts to kindly correct me if I am wrong.

Thika Tenancy Shop owner is himself a Tenant and can not sell the shop. He can utmost sub let his shop and the person who he has sub-let can not further sub-let to any body else. In the event of demise of the Thika Tenant, the land on which the shop situates, gets vested on the Government.
