(Querist) 05 March 2013 This query is : Resolved
What is the difference between probate proceedings and Letters of Administration?

If there is a registered Will and there are 6 legal heirs. out of that two sons alone are the beneficiaries as per the said will. Now should i file the Original Petition for letters of Administration or as probate proceedings. clarify the same at the earliest.

Thanks and regards

There is difference between the two. LoA is granted when there is no name of Executor.
Probate is granted when there is name of executor in the Will.
