status quo

Querist : Anonymous (Querist) 08 January 2011 This query is : Resolved
The plaintiff has filed a civil suit before Civil Judge Jr.Dn.Court for injunction. Court has issued emergent notice and passed an order of status quo.

Whether can we file application before the same court to vacate the order of status quo.?

Order 39 rule 4 .

YOU MAY FILE WRITTEN STATEMENT AND REPLY TO THE APPLICATION FOR INTERIUM INJUNCTION AND STATUSCO. THE SAID ORDER IS VALID TILL RESPONDENDS APPEAR AND FILE SAY.IN CASE YOU ARE OBJECTING THE SAID ORDER AND FILING WRITTEN STATEMENT THEN AFTER HEARING ARGUMENTS OF BOTH ADVOCATES,COURT WILL PASS ORDER .THE ORDER MAY CONTINUE TILL FINAL HEARING OR MAY BE VACATED.GOOD LUCK.

you can file application for setting aside the said orders. however, it is just an order of status-quo (i.e as is where is) and not stay. Read the complete order carefully.
