(Querist) 17 October 2010 This query is : Resolved
Dear Experts, I came across a property dispute where the person was hindu by birth and converted to christ. He had four daughters and 01 son of which 03 daughters had no heirs. All four daughters are dead and now son of the eldest daughter has filrd a case for the share in entire property. Ques: Is it possible to get him the share ? and how?
What are the laws for daughter's share in hindu and christ?

The moment any member of a joint hindu family converts into another religion, he would be automatically thrown out of the joint hindu family and he would have no interest whatsoever in the joint hindu family property. He is not entitled to any share in the property. Therefore the question of the grandson of such a person staking any share in the property does not at all arise.

conversion to other religion by hindu joint family member makes him loose his rights over the joint family properties and so on their children.

Dear sir, only father was converted to christ however daughters remained Hindu and married to hindu and her son who asks for share is hindu. The property in question was awarded to him for carrying out certain jobs for village during Maharaja times and being Hindu. As he changed to christ, wheather his entire family converted to Hindu automatically? And the property of christ can be given to his daughter?

Conversion of religion does not relinquish the law of inheritance. Only the rule changes in accordance with the religion.
