(Querist) 16 April 2012 This query is : Resolved
My wife's Grand mother has a residential property, she has 3 daughters & one son. Whether daughters will get equal share in the ancestral property or she can give only to her son through a will or transfer. The query is whether grand daughters will get equal share in grand mothers property.
Thanks.

Granddaughters has no share as long as the daughters/ sons are alive.

Daughters would get equal share in the property if the lady dies intestate.

However, for her self-acquired property she can make a will according to her wishes.

As the grandma of your wife is still alive having her ancestral properties. On her demise, her entire properties shall be divided equally among her sole son and all 3 daughters.

Granddaughters have no right therein till her daughters alive.

Rightly explained. Grand daughters are not entitled for any share as long as sons/daughters are alive.

Daughters have equal right on the property as that of sons.

In your case, the property will be devided into 4 equal shares.

Sirs, Thanks for your quick reply. My query has not been clear, I correct it. My wife's grand mother expired ( No will) & my wife's mother is alive. My wife's Grand mother has left a residential property. Her only heir, i.e., my mother in law has has 3 daughters & one son. Whether her 3 daughters will get equal share in their ancestral property along with 1 son or Mother in Law can give it to only to her son through a will or transfer. The query is whether daughters will get equal share in grand mothers property (after her demise) & her daughetr ( my mother in law) has become absolute/legal heir , alive.
Please advise, Thanks.

its not ancestral property of your wife's..

i mean your wife can not claim anything from your mother in law., the residential property should be treated as the personal property of your mother in law., in her life time she can do anything as of her wish..

in case if she died without any arrangement mean your wife will also get equal share along with other sisters, sole brother and if your father in law[if he is alive]

This is an acestral property which got passed on to your mother in law. She cannot dispose off this through will. All her children are equally eligible for their share in the property. She cannot transfer it to ber son alone through will.

This is an ancestral property in the hands of your mother in law so she cannot provide it to her sole son rather it shall be duly got divided in favour of all 4 sons and daughters on her demise but not during her life time.
