I leave my husband 3 year before due to tuff circumstance for me nad my daughter. That time she was 2 year old. My concern is I don't have current income proof of my husband but I have old salary slip and bank statement of 2015 at that time I was with him. Can I use these proof as his income proof which is the proof that he is able to get same or high salary current time? Kindly suggest me right way to get my maintenance for my daughter's future benefit.

You may submit application for maintainence to majistrates court with affidavit and list of documents under sec 125 of criminal procedure code. You have to mention your name ag occupation address and also name and age datte of birth of your child.you mention facts from date of marriage and cause of dispute and dates time and witness of any dispute and your unemployment and no source of income unable to maintain yourself and child and pray for maintainence from husband by giving details of name age occ address and income dteails with whatever proof available .it is advosible to file case through advocate to get expert legal help..good luck.n.b.sawant.advocate high court

Did you leave society of your husband or you had decree of divorce? If you have left the Society of your husband voluntarily without any cause, you are not entitled for maintenance for yourself. However, you can claim maintenance for your daughter as per records available with you.
