Sale of inheritance property.

(Querist) 22 January 2015 This query is : Resolved
sorry for my bad english.

Sir/Madam,
I have the 1/4 share in inheritance propery(Through my father side) which is in my mother name.

My wife is living with her parents and she has already filed a case u/s 498 (A).

We want to sale above inheritance property. But my wife name is also included in 'VAMSHAVRUKSHA' I want to know whether my wife is entitled share in above property?

Is it possible to sale the property without taking her signature in sale deed etc.,?
Please give me suggestion Sir/Madam.

1. Not it is not lawful to sell the property without her signature since her name too is shown in the VAMSHAVRUKSHA. Yet, some legal way can be found out.

2. If you have the time and resources try to contact this lawyer for further legal guidance and get my contact details by clicking my name shown in the L.H.S. margin of this reply.

if your wife is co owner of said property her consent would be necessary for sale of the property

How the name of your wife was added in property that is ancestral and in your mother's name?

You should show the property documents in person to a lawyer dealing in civil/revenue/property cases in person......
