Roznama

(Querist) 28 April 2009 This query is : Resolved
Sir/Madam,

Recently I procurred a copy of the Roznama to check and bring to the notice of the court that the complainant and his Advocate were being regularly absent for proceedings to my surprise the complainant has been marked as present on the last hearing while actually he was absent and the complainant advocate has filed an application for adjournment on this ground as the complainant was absent.

Further on the previous hearing to the above the complainant and the complainant Advocate both were absent and the application for adjournment was delivered to court by their office boy and for this act the complainant was penalised Rs.1000/- but the Roznama states as Advocate present.

What should I do?

i think u r not represented by a lawyer.if u have not engaged a lawyer then engage him.n adivce him 2 see all these irregulariteis.some times cases are taken by the court clerks n they write orders in casual !!!! manner, which is the main cause of all these irregularities.i think ur purpose 'll be served by engaging a lawyer

Yes. An efficient lawyer may be the penultimate solution. However, you should make an appropriate application to the concerned court and insist on each date to see the Roznama as and when the same is drawn.

In fact, case should be transferred to some other court in order to avoid daily difficulties.

both Dhiraj and Prabhakar are correct here, better to take advice of a lawyer on such matters, if u r not satisfied then u can seek for practical legal help from this portal, various lawyers are on the list here u can contact any one from ur state.

do make a complaint as suggested by Mr. Prabhakar.
