Right to information act

Dear all,

Can somebody let me know if the RTI Act applies to a pvt. ltd. company.

An advocate sought information of an employee of pvt company under the guise that his (the employee's) wife has initiated domestic violence case against him.

Is it mandatory under the act to reply it.

The information under the RTI Act can be accessed from a public authority which is defined under section 2(a) and section 2(h) of the Act.A Pvt Ltd company which is not substantially funded by the government does not fall in the ambit and the Pvt Ltd company is not obliged to reply to the request under the Act.

Thank you very much for the advice.

The Advocate has sent a postal order for Rs. 10/- along with his letter.
Could you please advice me, shouldn't it be sent back?
Also should I reply to the letter through an advocate?

the postal order can be returned stating that since,the private company doesnot comes under the rti act,the requested information cannot be given.

You may please act according to the advice of Mr. Sharven Kumar and Mahendra Kumar without any hitch, as the RTI applies only to the Government/public organizations.

You may reply direct also, not necessary through your advocate. However, it is your own discretion if you want to replay an advocate's application through advocate only. You may do so also for the safeside on legal angle.
