Right of pre-emption

Hon'ble Experts,

We have 7 acres of land at our village got from Grandfather. This land was acquired by our grandfather through kul-kayada. In the 7/12 it is mmentioned as class 2 owners. Can we sell this land? Do our uncles have right of pre-emption over this land in case we decide to sell?

Your uncles have no right to preemption as this right is now available only for tenant of the land and not for any other relative.

right to preemption is not available now. It was an old act which has been repealed may years ago.

For correct answer consult a revenue lawyer of your area or look into the state land Act.

The state is maharashtra. Kindly advise if there are any restrictions on sale for class 2 owners.

There is no restriction to sale to class 2 heirs even in Maharashtra.
