right of central government servant for higher studies

Dear Sir/Madame I completed 3years of service as a staff nurse in Jipmer, central government institute. Am i legally eligible for higher studies under loss of pay. If my superiors do not permit me, what should i do?

Generally, educational institutions insist for NOC from the employer when the employee student pursues higher studies. If you are prepared to go on loss of pay this will not be an issue. However, you need to check up with the service regulations of JIPMER whether the loss of pay would amount to break in service disturbing your seniority.

While the Direct Recruit officers (i.e. UPSC recruitees) are entitled for 2 years leave (with pay) for pursuing higher studies no such facilities are available for other government servants. However, a government servant is eligible to go on EXOL i.e. extraordinary leave without pay. This period will not amount to 'break in service' but would certainly not count as qualifying service for the purposes of pension. FOR pursuing higher studies you have to (i) disclose in the leave application for EXOL the reasons why you require such a leave i.e. you require the leave for the purposes of specific higher studies and also the institution and the period during which you would be pursuing. (ii) simultaneously, you should also obtain necessary NOC from your department for pursuing such a course. All the bests.

Leave rules do not differentiate in the mode of entry. Study leave can be availed upto 2 years if (i) five years service is completed (ii)Minimum three years service is left (iii) the cours eis beneficial to the employment.
