Retrospective operation of law.

(Querist) 29 August 2013 This query is : Resolved
To,
The Expert.

My query is about the applicability of the law in retrospective effect wherein the original provision have been altered subsequently.

To enumerate it further, the issue arose on the valuation of the property done by municipality retrospectively on the property on the ground of change of user.

But the provision have been altered subsequently by the amendment Act. Now the municipality have done the valuation retrospectively on the basis of the old provision.

Can the valuation be sustained.

Will be helpful, if the reply carried with judgment.

Thanks & Regards,

Dibakar ray

Mr. Dibakar,

In your views, under which section of which act the valuation of property falls?

There is a clear distinction between law, rules and administrative orders. So, to which law, rule or administrative order you refer, which is considered to have been made effective retrospectively in relation to your case?
