My brother got will of 25%share in house property.He has managed mutation of 25%share in his name.We two brothers are in exclusive possession of the property for the last 25. Yrs.He has filed case for claiming possession of25%share in property .we have challanged his will and mutation in court.case is in initial stages.Now he has filed case against us for claiming rent from date of Will for 25%share of house we r using.Since his will is challenged by us and matter is under consideration of court his claim for rent is maintainable or not

How you feel that the your questions are not hypothetical.

However, full case file / copy of the will property documents need to be referred, discuss with your lawyer.

For reply to your query better go to your tutor, who will reply your question. Don't think that the people before whom you have put your quesion, are merely idiots and you are only the wisest person on earth. If you thought that you have put your questions to idiots, only some big idiot can think like that.

Mind it, you are still a child in this field, where others have several decades of practical experience in the field to make distinctions.
