Registration under maharashtra apartment owners (mao) act

Hi,

Can a building with 4 flats, owned by members of a family, be registered under MAO Act, given the definition of building under the act stipulates existence of minimum 5 apartments?

(e) " building ,,-means a building containing five or more apartments, or two
or more buildings, each containing two or more apartments, with a total of five
or more a partments for all such, buildings, and comprising a part of the property

as per defition minimum 5 apartments are necessary
