Due to unavoidable circumstances my younger brother would unable to take part in the execution of sale deed. what is the solution>?

your facts are incomplete,yet i am trying to answer,now sale deeds are drafted and registered only in bilateral presence of buyer and seller,so in either case your brother should execute a special power of attorney in favor of a person of his choice who agrees to make his presence before the registrar on sale execution/registration date.

Yes, either he needs to be present at the time of registration or he needs to execute and register a POA in favour of any one he chooses.

Take care to register the POA. If he is in foreign country, the poa must be notarized.

IN CASE YOUR MATTER IS ATTRACTED AS Mr. Palnitkar v v UNDERSTANDS,THEN THAT P.O.A. SHOULD BE ATTESTED BY INDIAN EMBASSY IN THAT COUNTRY,ONLY NOTARIZATION WILL NOT WORK.
