Regarding punishment

(Querist) 09 August 2011 This query is : Resolved 
dear experts,

Supposing that a person has been convicted for the offense of murder of a person and has punished for the same. After completing his term of punishment, he found that alive and he killed him. whether he will be punished again or what kind of action might be taken against him.

ONE MAN CAN NOT BE punished MORE THAN ONE TIME FOR THE SAME OFENCE.

Very interesting question. He can't be punish twice for a same offence. But my question, without confirming the victim's death how he can be convicted earlierly..

If erroneously one person was punished against the charge of murder of some person which after completion of term of senense found false then he may only claim compensation and no license to murder such person is provided to him by any law so he shall have to face similar criminal cse.

No doubt he won't get the benefit of 300 Crpc and he will be convicted if found guilty as the offense is not one and the same.He can claim compensation for his illegal confinement.

There is settled law that no person can not be vexed twice. But at the same time you are not free to murder that person. You can file a complaint with the police or the Court as well and can also file a civil suit for damages.
