Refund of admission fees

DEAR MEMBER NEED YOUR ASSISTANCE IN BELOW MENTIONED QUERY:

THE CANDIDATE LEFT THE INSTITUTE INTENTIONALLY BEFORE THE COMMENCEMENT OF THE COURSE. HE CLAIMED FOR REFUND OF FEES BUT AS PER THE RULES OF PROSPECTUS HE IS NOT ENTITLED. FILED COMPLAINT BEFORE CONSUMER FORUM ON THE GROUND THAT NON REFUND OF FEES AMOUNTS TO LACK OF SERVICE. HENCE, THE ORDER WAS PASSED AGAINST US.


MY QUERY IS THAT:
1. WHETHER GOING FOR AN APPEAL WILL BE HELPFUL FOR US BECAUSE THE CANDIDATE HAS LEFT THE INSTITUTE BEFORE THE COMMENCMENT OF THE COURSE HENCE, THERE IS NO SERVICE PROVIDED TO HIM.
2. WHETHER RULES LAID DOWN IN PROSPECTUS WILL BE CONSIDERED AS A VALID CONTRACT.

1. With the given facts, there is no use of going for an appeal. Because, as the candidate have cancelled his admission before commencement of the course he is eligible for the refund on the basis of principle of natural justice.
2. Rules of the prospectus are framed by you and such private rules and regulations have no value in teh eyes of law when it is against the principle of natural justice.

you dont have case . no sense in going in appeal .

th rules framed by you are arbitrary and framed to enrich your self at expense of students .

if student has not ttaended a sinlg lecture and claims refund you ought to grant the same . order passed by consumer forum is just and proper

All rules and regulation framed by u are only to safeguard your own interest and don't followed principle of equality of balance in framing rules and regulation to safeguard student's interest also. In these circumstances law of the land will apply and all judgment/ order will pass in the light of law of the land.In case you/ your lawyer find any wrong in passing judgment/order you must go into appeal.
