Recovery of money

Recovery of money suit can be filed U/O VII Rule 1 Of CPC.
The procedure required as any other Civil suit.

You have to take the limitation act into considertation. The suit can also be filed under Order 37 of CPC.

Recovery of money is an ordinary civil suit and follows the same procedure as any other civil suit.

You can get to know about the time limit to file the case, only if u tell the nature of transaction that happened. For promissory note, it is three years time limit to file a case.

The procedure is like any other civil suit. give the details of the transaction, show how much money is due and how you are entitled to recover. Also state when the defendant refused to pay you and when the cause of action arose. state what is the valuation of the suit and pay court fees according to valuation. Make a prayer for recovery. File affidavit in support of the claim

Very nice Sinha ji ! you wanted to know complete procedure that can be known after going through at least entire CPC , Limitation Act, Court Fees Act, the Act applicable to natur of transaction, Civil Courts Act etc. and you got satisfied in few sentences....!!!!!!!!

Well Mr.Tripathi I just wanted to know the general procedure of civil suit recovery, as it is not my area of practice.Though I can state very candidly that still I want to the relevant sections which is applicable to the issue, I just hope that you can provide me about.
