Rcr

(Querist) 27 February 2013 This query is : Resolved
In this case, wife never attended procedings of RCR inspite of having knowledge and hence the judge decreed exparte.a year ago, looks like there is a fake DV case that the husband might need to fight, will the exparte RCR help the husband? if yes how effective could that be?

Regards.

Dear Mr.Ramesh Bolla,

Despite recieving the process if the respondent/wife chooses not to contest impliedly it means that she is admitting the allegations of husband and being proceeded ex parte means that she does not have any defence. Yes positively this will help the initiator of proceeding being husband.

Best regards

wife wont be entitled to maintenance if she has deserted her husband without any just cause . in your case you are willing to stay with her . court has passed an order for RCR in your favour . it will help you in DV and maintenance cases
