Query about my salary

i have worked on saturday then after sunday i have taken holiday on monday and tuesday so will my sunday's salary will get deducted or i will be paid for sunday.

It depends upon your service rules. There is no strategic rules for all sectors of employees.

you are HR, as per your profile.
r u a management staff??
if yes, no salary ded., no overtime too.
You may be compensated for Taxi travel & hotel Lunch etc.
there is no question of salary deduction.

If you are Workman, OT & it depends on your Settlement with Union as bargained, or Company Rules.
Why cant you clarify with your Boss? whoever told you to work.

You should have applied for compensatory off in lieu of your duty performed on Saturday and Sunday, if there is a five days work week in your organisation. You can request the management even now to convert your leave in to compensatory off.

Generally, you can claim compensatory off for working on holidays. But, it depends on policies of organisation.

Respected All,

I have been told by my hr manager that as per labour law of india he can deduct my salary. in my organisation there is 6 days working days.saturday was not my holiday

I have not worked on sunday.Saturday was my working day.

Yes i was HR Recruiter with overseas , as per your profile.
Many times i worked overtime also.even during election voting time we have worked.No compensation has been provided to me for Taxi travel & hotel Lunch etc.
If there is no question of salary deduction then i dont understand why these people have deducted my salary.
There are no OT rules but we have worked many time overtime.
My HR Manager is only creating a problem.

Please solve my query. As per my knowledge If i will take holiday on saturday and monday then my salary will be deducted. otherwise i i have taken holiday on monday and tuesday after sunday, then my salary should not get deducted . am i right?

Yes, you are right. If you take leave on Monday and Tuesday, they cannot deduct your salary of Sunday.

Dear Vanita,

First of all you should be able to know the difference between the terms of holiday and leave.

About your query, if Sunday or any declared holiday (closed day) is prefixed or suffixed (i.e., before or after) to leave applied for, the HR does not have any right to deduct salary for the closed day. However, if Sunday or declared holiday falls in between the days of leave that would form part of leave and only leave salary, if due becomes payable.

If the HR Manager believes that the salary of Sunday is to be deducted as per labour laws, ask them to quote the relevant provision of the concerned labour law.

As u r management staff, I wonder why Leve salary be deducted.

send Regd Letter demanding clarification, and inform, you are constrained to take legal action, unless you justify my demand.
Sunday being holiday, no question of deduction of salary for that day.

Clarify with HR, which day sal was deducted?? why?? Then compensate against all OT u worked extra for no salary or wages or taxi bill. . Next time when you work OT, produce Taxi Bill & Hotel Lunch, and insist they pay it, or ask for Company transportation, if delayed over 30 mts from closure of Office hrs, or refuse to wait longer, if facility is refused by co.

Let Directors know this fact, write to them [OT, NO TRANSPORT , NO LUNCH, DED OF SALARY FOR NO REASON ETC]

Start correspondence in writing and create evidence on record, so that the HR Manager may spell out reason why he is not in favour of allowing salary for Sunday.
