Proxy

Querist : Anonymous (Querist) 28 November 2011 This query is : Resolved
S, a shareholder appointed P as proxy. Both attended the company meeting. S the shareholder voted on a resolution. P too claim the vote on the resolution. What will be the claim of P?
Raj Kumar Makkad (Expert) 28 November 2011
As Principal Shareholder S himself is present there so his agent P has got no right to vote on resolution.
Sailesh Kumar Shah (Expert) 28 November 2011
P claim is valid until written notice of revocation has been received by the company before the commencement of the meeting or adjourned meeting, as the case may be.

Please ignore earlier post.
The proxy shall stand revoked if a member, who has given the proxy, attends the meeting personally. [Cousins v International Bricks Co. Ltd. (1932) 2 Comp Cas 108 (CA)].
