Dear Experts,

My father had a house in meerut. I have One Elder brother and two elder sisters. My parents lives with my elder brother and had bad relations with his parents. I live in Faridabad. My parents are debtiess paients. I want to shift my parent in faridabad and My father want to sale this house but my brother not want to sale this house.

Please advise what is the law of father property.

My father alone the owner of the house by purchase

Is your father alone the owner of the house by purchase or he has inherited it from his father?

If he has inherited from his father then was it a purchase by his father or his father got it from his father??

Without these facts no proper advise is possible.

is that property is self occupied by your father , or inheritance .IF his own then no need to worry to sell by him but all subject to his wish and decision .
But it from your inheritances it need legal formalities.

Then in such a case where the house proposed to be sold solely belong to your father none of as sons or as daughters or your mother or any body in the world can check his hands and he being absolute owner is FREE TO SALE IT TO ANY BODY HE LIKES IS MY FINAL ANSWER.

Your father should not care for your elder brother for the sale of his absolutely owned and possessed house. Your father can make sales as per his sweet desire. Your elder brother can be given a notice to vacate his house by your father of sale can be made to him on some lesser rates for future relationship.
