my grandfather had gifted a house property to my father 20 yrs back as per conditional clause that the said property shouldnt be sold out to any outsiders other than blood related family members.. my father after acqiring ownership transferred the above propety to my mother through a sale deed.. now dat both my grandfather and father has expired can my mother sell the property to any outsider....
please help

Your mother is absolute owner of the property and is not bound by any condition of gift imposed by your grand father over your mother so she is free to sale it to the person of her choice.

my uncle(father's brother) had been forcing my mom to sell the above property to him only and that too not according to the present market value... and moreover used to threaten her that he will sue her for selling the property to any outsider... in that case what can be the defends my mom could undertake

you place it on record that present market value of property is X amount . tell your uncle if he is able to offer you X amount you will sell the property to him . in case he is not in position to pay the market value X sell the property to an out sider . your uncle wont get any stay from any court .

Your uncle cannot sue your mother just on the ground that she is selling her property to some outsider.
