hi,
i have seen a land to puchase it. owner of land are 5 brothers. but in revenue office the documents name of three persons only.
when i remaining two brother whose name are not in document say that we dont have any problem if they sell land because that particular piece of land come under there share.

my question is that while puchasing land i should get signatior of all 5 brothers or 3 brother in whose name document is there.

If the land is an ancestral property or a property transfered from father to sons untestate, then it is advisable to obtain signature of all the 5 brothers.

If the property is purchased by the 3 brothers only, then no need of singn on other 2 brothers.

If the property is self aquired property of father who later transfered to the 3 sons, then no need of signature of other 2 sons.

Check the history of the property and consult a lawyer before deciding to make payment.

It shall be better for you to go in depth of the status of the property since last 30 years by way of a detailed search report. It shall not only clear your question but more and more question whether there are other owners of this property or not or whether the persons shown in the revenue record are the valid owners or not.

On coming to know the true picture, take action as desired in the relevant situation.

Let 03 in whose name property is to execute the desired sale deed after due inquiry of their title and get sign of 02 as no objector so that nothing remains for future dispute with them.
