Property claim on parent's asset indian women

Querist : Anonymous (Querist) 15 January 2012 This query is : Resolved
Hindu Family..Kerala
Mother + 3 Brothers (only 1 brother is alive now) + 2 sisters (1 died)

My mother got 3 brothers and 2 sisters and these sisters got married before 1954. Moother's marriage was in 1974. The partition of her parent's asset was donein 1977 and the assets were devided among 3 brothrs only and there was no Will written by Grand father/Grand mother. None of these ladies got any share of their parents asset. Only one uncle (mother's broethr) is survided now, and whether we can claim for her share of property . My Mother confirmed she never gave any signature anywhere so as to release her right on that property. Also interestingly, when I checked the partition document, I could see only the name of these 3 uncles and their children , but not mentioned anywhere about these 3 sister's name. So whether this is a clear manipulation and how we can proceed to claim the property
Your advice is highly appreciated..

gradfather expired in 1952
grandmother in 1982
partition in 1977

Your mother and her both sisters (if either of them died then her legal heirs) have got legal right to claim 1/12 share each in the entire properties left by your maternal grand parents.

Your mother can file a civil suit for partition and possession and the entire events shall be reversed. Criminal case can also be got lodged as this is also a fraud.
