Private complaint u/s.200 Crpc

Sir,

Divorce case U/s 13 and Conjugal Rights case U/s. 9 of the Hindu Marrriage Act 1955 were pending before family court. Under this circumtances can I file a private complaint about 2nd marriage of the Husband

I dont kno as to why u filed a case u/s 13 and u/s 9 of h.m.act side by side, in the first petn u pray for divorce on the othe hand u pray for RESTORATION C R ? AND for what u want to file a case u?s 494 ipc?

as far as ur query is concerned, yes u can file complaint u/s 494 read with section 200 crpc.

You have every right to file a private complaint for bigamy. The police will also take up the case.

Until the divorce suit is not finalised by the court,the second marriage is void and also punishable u/s 494IPC .You have the full liberty to complain for about this to the police and if the police does not take any cognizance then to the court concern .

In this case, any supreme court case law available against filing private complaint where the family court proceedings were pending?
