Power of attorney

DEAR ALL,

I WANT TO BUY A PROPERTY BUT SELLER RESIDES IN USA , SHE IS WILLING TO ISSUE A POWER OF ATTORNEY IN MY FAVOUR FOR EXECUTION OF DEED OF CONVEYANCE FROM INDIAN EMBASSY. CAN YOU TELL WHETHER THE SAME IS VALID AS MYSELF IS THE PURCHASER AND ON THE OTHER I AM ALSO SIGNING ON BEHALF OF OWNER AS HER ATTORNEY.

let the seller issue power of attorney in favour of any relative in india

You cannot sign on both sides. It is common sense....

Agree you can not sign both sides. POA can be issued in favor of some of her relative.

POA would simply give you an authority to deal with the property, but when you transfer to your own name your action may come under the ambit of a doubtful transaction. You can also lose property if she files a case of cheating and illegal possession in her absence being away in a foreign country.

So, must think wiely before you act. Better act on the previous advices of experts.

if the lady desperatley wants to ssell the property tell her to come to india sign the necessary papers , have document regd and take the sale proceeds .

it is al;ways advisable to err on side of caution . if she cant come to india let hergive POA to relatives as advised earlier .
