Power Of attorney

(Querist) 28 November 2017 This query is : Resolved
Respected seniors,
I have filed a cheque return complaint through Power of attorney holder. A wife has executed the said POA in favour of her husband to file a case but , specific reason for execution of said POA is not mentioned, now question is that, whether it is compulsory to mention reason for execution of POA?
Dr J C Vashista (Expert) 29 November 2017
Neither mandatory nor compulsory to disclose reasons for granting power to the attorney.
However, it would be appropriate to disclose the reason(s) for grant of power is to avoid any question on the subject in the cross-examination while the attorney will be subjected to depose before the Court.

Agree with the expert Dr.J.C.Vashista.
V R SHROFF (Expert) 29 November 2017
Tough not compulsory to mention reason for POA; be prepared to reply in cross exam.
Own Personal knowledge of transaction and dealings is most important; including signature on Cheque, total transactions to prove legal liability, and legal notice in presence.

Ungrateful author do not use "like" or "dislike" button in appreciation or depreciation of the Social Service, being FREE OF COST.

THANK YOU So MUCH, sir. I simply love my profession and you are a senior lawyer too so I don't want to stretch the thing, though our constitute believe in freedom of speech but one should not cross his limit.
