Possession on other land

If after conducting private survey it seems that on some part (may be 12 x 30 ft.) Some other person has possession from last 12 years on that land. Meantime nobody have objection for the same. My queries are: -
1.Then whether that possessor has right over that land.
2.Can legal complaints file against that possessor?
3.What is the solution available for that possessor?
4.Then is it necessary in the eye of law for that possessor to vacate the said land?

who is the owner of the property?for the plea of factum of possession it should be known to the owners for successive 12 years.
