Querist : Anonymous (Querist) 28 August 2011 This query is : Resolved
in one of the case crime branc accused 7 people out of which 2 (one officer and one grade 4 employee, both had nexus) were absconding for 5-6 months. their bail application were rejected by HC about 2 months back. now they have got bail. They are in govt office.
after getting bail now they are asking one of the employee of their department (who is person of integrity and honesty and the same is confirmed by crime branch) to have a telephonic conversation.
this May be to entangle him so that get absolved from the case. they may record his conversation and may force him to accept fact whihc he may have (not sure) carried out to obey his boss since he has no option but to follow instructions of his boss (this happens in govt offices).
please suggest what should be the course of action of other employee? what are his rights?
I want to help the an employee who is set an example for me of honesty by scolding a guy who was trying to offer him bribe.
Please helppp ASAP.

Such employee should not follows illegal orders of his corrupt boss and should bring such illegal orders to further superior officers of his organization. He should record the conversation of such boss containing always illegal contents.

In conduct rules for Government employees there is a clear provision that if any superior asks his subordinate to do some work which is not in conformity of the rules of the Government, he may get his written approval.

However, if the employee thinks that the superior authority has ordered him to act in an irregular manner he can resubmit the case to his superior to confirm his order by pointing out the nature of irregularity or likely infringement of any rule of the organization.

So, he should get every order in writing and keep copy of each such written order with him for his defence, so that at any time, if the officer manages to tamper with the evidence, he can produce the copy to the inspecting officer, when questioned.

If there is any prima facie proof that the accused persons are trying to influence the witness or posing any hindrance to the ongoing investigation then the said person with the help of the de facto complainant may apply for rejection of bail grnated to those accused persons.

It would be a good case for rejection of their bail.

I sencerely thank all the your expert advice.

The fact is the other employees is no where in the police investigation infact DCP crime branch has full faith in him whereas his officer along wiht other class-4 employee is absconding. Since the officer managed to get AB now he is trying to pour his allegations on the other employee because the other employee followed his order in the past. (in the past that employee could not raise his voice against wrongdoing and followed orders of his boss because he could have faced false charges and due to fear of suspension)

I can sense he is victim of corruption whihc has top-down approach but he is niether part nor originator of corruption.

since he is not higly paid he can not afford advocate, also abstain to lodge any complaint/ FIR againt his boss who can do anything since his brother is some DGP/ IG of police.

Pls suggest..
