Pension

My client was serving in State Education department which was pensionable job and after left this job he joined Central govt education school job which is not pensionable . Whether my client is entitled for pensino from Central department on the ground that he left a pensionable job and joinded central govt job.

@Author, from the year 2004 any candidate appointed in Govt. job, he is not eligible for pension as is before 2004. And moreover some rules are different from Central Govt. and State Govt. however he is not eligible for pension.

Is your client eligible to grant pension under the pension rules? If yes, s/he will get it.

I do not want to agree or disagree with the views above because fullfacts are not there.

(i) Why do you feel new job is non-pensionable.
(ii) has he gone on ehcnicla resignation.
(iii) did he apply throght proper channel.
(iv) whether new job is in deptt or autonomous body.
(v) when the switchover took place.

my client has been retired and getting no pension because there is no pension in JNV Schools. whether he can file case on the basis of prior job which was pensionable, on the ground that job which he left was pensionable . He wants to file case against JNV anothorities for pension .

Foolishness if made is not rewarded. He could well have thought prudently before leaving pensionable job.

why he could not get pro rata pension on joining (on absorption) in an autonomous body.

He had opted this job for that for the obvious reasons called benefits. Now since his benefits are achieved, he greed thoughts about the earlier compromise made recurs, right? In fact he knew that there is no pension in this service well before quitting the previous pensionable service, now what prompts him to rake the issue legally, I am afraid he may not succeed since he has accepted it voluntarily and was not thrust upon him forcibly.
